alice&jann is a brand by Studio Jaag.
1. Scope
These General Terms and Conditions are applicable to all aliceandjann.com | aliceandjann.nl | Studio Jaag customer contracts (§ 13 BGB) which have been made via our online-shop.
A consumer refers to any natural person who enters into a legal transaction for a purpose attributed neither to their commercial nor independent occupational activity.
2. Contracting parties, customer service

3. Conclusion of the contract
By placing products in our online shop, we submit a binding offer on the conclusion of an agreement on these items. This agreement is completed when you place a binding offer for the goods in your shopping basket by clicking the order button. Immediately after sending an order you will receive another confirmation of receipt by e-mail.
4. Prices and shipping costs
In addition to the indicated product prices, shipping costs have to be applied.
For deliveries within the EU, we charge a flat fee per order. For orders exceeding a value of €200,- delivery within the EU is free of charge.
The shipping costs are clearly indicated on the product pages, in the shopping basket system and again on the order page. The prices stated on the product pages include the statutory value-added tax and other price components.
5. Payment
Payment can be made by iDeal, Paypal, credit card, or immediate transfer.
5.1 Credit cards
Your credit card will be charged upon order completion.
If you choose to pay by credit card, an additional 2.95 percent of the purchase price is charged.
5.2 PayPal
If you choose to pay the invoice amount through the online provider Paypal, you usually have to be registered on the PayPal site or need to register, gain authorization with your access data and then confirm the payment order to us (unless you use a guest account, where appropriate). You can receive more information during the ordering process.
If you choose to pay by PayPal or PayPal Express, an additional €0.35 is charged.
5.3 Immediate transfer / direct payment.
We also offer you the possibility to pay by immediate transfer. With this option, we directly receive the credit transfer which accelerates the entire ordering process. In order to this you only need your account number, sort code, PIN and TAN numbers. Using the Sofort AG secure payment form, which is not accessible to any vendor, sofortüberweisung automatically triggers a transfer in real time to your online bank account. This means that the purchase amount is immediately and directly transferred to the vendor’s bank account.With this type of payment we charge a transaction fee to the amount of €0.35 per transfer, which is shown in the ordering process.
If you choose to pay by immediate transfer, a pre-completed form appears at the end of the ordering process which already contains our bank details. Furthermore, the transfer amount and the intended purpose will already be displayed in the form. You only have to select the country where you have your online bank account and enter the sort code. Then provide the same data you use to log into your online banking (account number and PIN) and confirm your order by entering a TAN number. You will receive confirmation directly following the transaction.
In principle, all internet users can use immediate transfers as a payment method if they have an active online banking account with a PIN/TAN. Please be advised that immediate transfers are not yet available for some banks. You can find out more information about whether your bank supports this service here: www.payment-network.com
5.4 Other payment service providers with an immediate transfer option
We also offer the following payment method: iDeal.
6. Customer collection
We only deliver by mail. Personal collection is unfortunately not possible.
7. Offsetting
You are only entitled to offset if your counter claims have been legally established, if they are undisputed or have been acknowledged by us in writing.
8. Right of retention
You may only exercise a right of retention if the claims are based on the same contractual relationship.
9. Reservation of title
The goods remain our property until payment has been made in full.
10. Damage during shipment
If goods are delivered with apparent shipping damage, please immediately inform the delivery service and then promptly contact us. Failure to file a complaint or notify us will not have any consequences concerning your legal claims or the enforcement of those claims, especially not with regards to warranty claims. It would nevertheless help us to assert our own claims against the delivering company or transport insurance company.
11. Right of return
Instead of a right of withdrawal, consumers have a 14-day return policy.
You may return the received goods without providing a reason for the return within 14 days. The period shall begin after receipt of this notification in writing (e. g. as a letter or e-mail), but not before the goods have been received by the customer (in the case of recurring deliveries of the same goods not before receipt of the first partial delivery) and also not prior to performance of our duties of disclosure pursuant to section 246 § 2 in conjunction with § 1 subsections 1 and 2 of the Introductory Act to the German Civil Code (EGBGB) as well as our duties under § 312g subsection 1 sentence 1 of the German Civil Code (BGB) in conjunction with section 246 § 3 of the Introductory Act to the German Civil Code (EGBGB). Only when goods cannot be returned as a parcel (e. g. bulky goods) may they be returned by a demand for collection in writing. To comply with the notice period, timely dispatch of the goods or of the return demand is sufficient. In any case we bear the expense and risk of return deliveries.

Consequences of return
In the event of an effective return*, the services received on both sides, including any benefits already derived, must be returned. If the condition of goods has deteriorated and in cases where benefits (e.g. benefits from usage) cannot be returned in their entirety or only in a deteriorated condition, you shall have to pay compensation accordingly. You will only be obliged to render compensation if the deterioration of goods and benefits derived is due to handling the goods in a way which exceeds testing the principles and functions. ‘Testing the principles and functions’ means trying out and testing the respective goods in the same manner as it would be usual and possible in a shop. You must satisfy obligations with regards to the reimbursement of payments within 30 days. This time period begins for you with the dispatch of the goods or return request, and for us upon receipt.
*Please be advised that return shipments may have an impact on shipping cost calculations.
If, after the return shipment, the order value continues to be over €200,- you would not incur any shipping costs. However, if the invoice amount falls to below €200,- after a shipment has been returned, free delivery offer no longer applies. In order to continue managing this payment procedure in an optimal way for you, we calculate the usual shipping costs with the refund amount for your return delivery.

We save the text of the contract and send you the order data and our Terms and Conditions by e-mail. You can also access and download our Terms and Conditions on this site at any time. You can see your previous orders through our customer log-in.
13. Contract language
The language available for the conclusion of the contract is Dutch, German and English.
